Abstract

Nowadays, settlement of criminal cases out of the court through restorative justice is essential for Indonesian  society. State Police of  the Republic of Indonesia as the bearer of the state government's function of law enforcement duties, in addition to provide protection, safeguard and  service to public are expected to be able to realize the demands of the community to achieve justice. The public has high expectations for the State Police of  the Republic of Indonesia as one of the law enforcement officers, who are authorized by law as investigators to carry out investigations of all criminal acts in the context of law enforcement.  Certainly, law enforcement is carried out according to the priority program of the National Police Chief which carries the concept of Transformation towards a Predictive, Responsive and Just Transparency Police (PRESISI) for the realization of legal purpose.

Abstract

The Indonesian Financial Transaction Reports and Analysis Center (INTRAC) is an independent institution under the President which was established with Law No. 8 of 2010 concerning the Crime of Money Laundering. Function of INTRAC are as follows: prevention of money laundering, data and information management, supervision of the compliance of the reporting parties and analyze or investigation of financial transactions that there are reasonable grounds to suspect are related to the commission of a money laundering offence or other crimes acts as referred to in Article 2 Section (1). From the duties and authorities mandated by the Money Laundering Law, PPATK has at least 5 functions, namely financial intelligence, regulators, coordinators, mediators and assistance in law enforcement.In addition, the Financial Transaction Reports and Analysis Center (INTRAC) as an independent institution, also carries out an investigative function, namely collecting, storing, analyzing and evaluating information on transactions that are suspected and suspected of being money laundering.The Indonesian Financial Transaction Reports and Analysis Center (INTRAC) was established with the authority to implement policies to prevent and eradicate money laundering while establishing an anti-money laundering regime in Indonesia.

Legal Protection For Consumers Of Product Warranty In Business Law

Abstract

In article 30 of Law No. 8 of 1999 concerning Consumer Protection expressly regulates the authority to supervise business actors carried out by the government, the community, and the Non- Governmental Consumer Protection Institute (LPMSM), but the facts on the ground consumers still get product guarantees from business actors that are not in accordance with Law No .8 of 1999 concerning Consumer Protection. This shows that there has been an imbalance between regulations and facts on the ground. The problem in this study is how consumer protection against product warranties in business law and what are the consequences of warranties that are not in accordance with Law No. 8 of 1999 concerning Consumer Protection. This research method uses a normative juridical approach, with secondary data collection, to prove the consequences of guarantees that are not in accordance with Law No. 8 of 1999 concerning Consumer Protection. The data obtained were analyzed qualitatively. Based on the results of the study it was found that many losses experienced by consumers related to guarantees, such as fraud against store guarantees, fraud against bank guarantees, and others. Therefore, the government provides guarantees for the protection of consumers against product warranties through government regulations, one of which is the UUPK. In its implementation, consumer protection has not been carried out to the fullest, this is proven because there are still many irregularities and losses felt by the government. Whereas in the UUPK the sanctions/consequences received by the business actor if committing a violation related to goods will be subject to criminal acts.

The Role of Law in Sexual Violence Against Minors

Abstract

The rise of sexual violence or rape among minors, people flock to ask for criminal penalties for perpetrators of sexual violence. This clearly violates sexual morals, social morals and even religious morals and has a negative impact on child growth and development or puberty in today's children. Sexual violence is very rampant because victims are reluctant to report and they are forced to remain silent by perpetrators of sexual violence. In addition to providing psychological trauma, violence can also cause physical trauma and will make the victim haunted by excessive fear. Therefore, parents must know more about sexual violence that occurs in minors. The problems in this study are: what are the forms of sexual violence crimes that occur in children. What are the factors that encourage sexual violence or cheating on minors. And finally, what is the action or role of the law in tackling criminal acts of sexual violence that occur in minors?. Whether the role of the law is equal and can pay for the psychological and physical trauma of victims who lost their virginity due to violence during their teenage years. He should have received higher education and was in the process of achieving his goals, but was hampered because of outrage or what is happening in the present.

Kejahatan Bioterorisme Dalam Perspektif Hukum Pidana Indonesia

Abstract

The crime of bioterrorism is a terror threat that is very dangerous and difficult to detect so that it will have a major impact on the fulfillment of human rights, the regulation of bioterrorism crimes in Indonesia which has not been limited has increased the chances of attacks by biological agents that can occur at any time. The purpose of this research is to analyze the actions that are classified as bioterrorism crimes in the perspective of the Law on the Eradication of Terrorism Crimes and to analyze the forms of bioterrorism crime attacks. The results of this study are First, the laws and regulations in Indonesia which regulate the crime of bioterrorism are still inadequate because they are not regulated in a limited manner. Bioterrorism crimes are still generally regulated and considered the same as the usual forms of terrorism, even though the forms of attacks and weapons used in bioterrorism crimes are very different. Second, there are several methods used by terrorists in sending biological agents which can be classified in the form of 1) The method of delivery by using aircraft or spray tanks. 2) The method of intentionally sending animals or plants that have been infected by a biological agent to spread disease in a desired target area; 3) Sending pathogenic biological agents directly through conventional delivery such as through PT. POS, JNE, JNT if in the context of Indonesia.

Vehicles are already attached to the human self and cannot be released. But motor vehicles also make a bad impact on humans. Along with the development of the times, electric vehicles were created that are environmentally friendly. Therefore, the Government supports the development of electric vehicles, by issuing several regulations and regulations. 

The research method that the author uses in this study is a normative juridical approach. The normative juridical approach is an approach that is carried out based on the main legal materials by examining theories, concepts, legal principles and laws and regulations related to this research.

Abstract

Pencemaran Lingkungan sudah seharusnya menjadi perhatian serius untuk setiap kalangan baik masyarakat, dan pemerintah wajib untuk menjaga kelestarian lingkungan sekitar dan juga mencegah dan mengantisipasi akan terjadinya pencemaran terhadap lingkungan. Dalam UUPLH terdapat satu asas yang mengatur terkait pencemaran beserta tanggung jawab pelaku pencemaran tersebut, yaitu asas pencemar membayar.Asas pencemar membayar secara resmi dikenal sebagai Polutter Pays Principle pada Deklarasi Rio 1992, adalah bagian dari serangkaian prinsip yang lebih luas untuk menuju pembangunan berkelanjutan di seluruh dunia. Di dalam asas ini, setiap pelaku kegiatan usaha yang dalam kegiatannya melakukan perbuatan melanggar hukum berupa pencemaran dan/atau perusakan lingkungan hidup atau menghasilkan polusi yang menimbulkan kerugian pada orang lain atau lingkungan hidup, harus menanggung biaya pengelolaannya dengan cara mengganti kerugian dan/atau melakukan tindakan tertentu terhadap apa yang dilakukan oleh pelaku kegiatan usaha tersebut untuk mencegah kerusakan pada kesehatan manusia atau lingkungan.

Abstract

Kehadiran anak dalam perkawinan merupakan impian setiap pasangan suami istri. Namun kenyataannya impian untuk memiliki anak tidak semua pasangan suami istri dapat memperolehnya dengan mudah dikarenakan berbagai macam faktor. Dewasa ini dalam kehidupan masyarakat Indonesia sudah mulai mengenal dan melaksanakan upaya kehamilan menggunakan jasa Ibu Pengganti untuk mengatasi permasalahan yang dihadapi pasangan suami istri yang sulit memperoleh anak dengan adanya perjanjian terlebih dahulu. Adanya kekosongan hukum mengenai Ibu Pengganti sangat memberikan pengaruh terhadap status dan hak waris anak yang dilahirkan Ibu Pengganti. Dalam penelitian ini, penulis melakukan penelitian yuridis normatif dengan melakukan pendekatan terhadap undang-undang. Sehingga didapat kesimpulan bahwa anak yang dilahirkan dari seorang Ibu Pengganti dapat dikategorikan sebagai anak luar kawin menurut Kitab Undang-Undang Hukum Perdata.

Abstract

Narapidana adalah seseorang di anggap bersalah karena Tindakan atau perbuatannya dan telah memperoleh Putusan Pengadilan yang sudah berkekuatan Hukum tetap sehingga bisa dikatakan sudah menjadi Narapidana atau Terpidana, yang dimana selanjutnya adalah menjalani masa hukuman didalam ruang tahanan atau lebih akrab disebut dengan Lembaga Pemasyarakatan (LAPAS).

Lembaga Pemasyarakatan adalah Lembaga yang bertujuan untuk memberikan Pembinaan kepada Narapidana termasuk Narapidana Wanita. Penelitian ini menggunakan metode yuridis empiris yang dimana menggunakan data yang diperoleh dari gejala sosial yang berhubungan dengan penelitian ini dan dengan berdasarkan kepada norma yang berlaku.

Pelaksanaan pembinaan terhadap Wanita di Lembaga Pemasyarakatan berdasarkan Undang - Undang Nomor 12 Tahun 1995 Tentang Pemasyarakatan yang mana telah dijelaskan bahwa seorang Narapida yang walaupun telah hilang kemerdekaannya, akan tetapi didalam Lembaga pemasyarakatan masih memiliki hak-hak sebagai warga Negara dan hak-haknya tersebut telah dijamin oleh Negara. Didalam Pelaksanaan – Pelaksanaan Pembinaan terhadap Narapidana Wanita yang berada di Lembaga Pemasyarakatan Tanjung Gusta Medan ini sudah efektif dilihat dari program-program kerja yang telah dilaksanakan untuk mengembangkan keterampilan baik itu dari kesenian atau bahkan keagamaannya.

Peraturan perundang-undangan telah banyak mengamanatkan tentang persamaan gender mengenai kedudukan antara Laki-laki dan Perempuan dalam aspek Berbangsa dan Bernegara. Peraturan pembentukan perundang-undangan baik untuk perundang-undangan ditingkat pusat mapun ditingkat daerah perlu mempunyai pemahaman yang sama dalam pengimplementasikan pengintegritasan kesetaraan gender dalam proses pembentukan peraturan perundang-undangan dengan mengacu pada sumber, dasar dan asas-asas materi buatan sesuai jenis dan hierarki peraturan perundang-undangan.

Application of Cyber Notary as a Solution in Making Electronic GMS Minutes During Pandemic Situation

Abstract

Abstract: This article analyses the application of cyber notary in making the Deed of Minutes of the Electronic General Meeting of Shareholders (GMS). The purpose of this article was to find out the juridical analysis regarding the application of cyber notary in the making of the minutes of the electronic GMS. The result of this research is the GMS electronically divided into two types of companies, Public Companies and Closed Companies. A Public Company in making the minutes of the meeting has a legal base in the Financial Services Authority Regulation Number 16/POJK.04/2020 concerning the Electronic Implementation of the General Meeting of Shareholders of a Public Company, while for a Closed Company it has a legal base in Article 77 of Law Number 40 of 2007 concerning Limited Liability Companies. In making the Deed of Minutes of the Electronic GMS held by a Public Company, the Notary can make a deed of the minutes of the GMS by cyber notary. As for closed companies, it’s divided into two reasons for making the deed: firstly, a meeting discussing changes to the articles of association can be made a Deed of Statement of Meeting Resolutions, secondly, the meeting that discusses other than changes to the articles of association can be made a Deed of Minutes of the GMS by cyber notary.
